Step-by-Step: The NC Foreclosure
Process
- MISSED PAYMENTS: Foreclosure
usually begins after 3-4 months of
missed mortgage payments. - PRE-FORECLOSURE NOTICE: The
lender sends a formal letter warning
you that foreclosure may begin soon. - NOTICE OF HEARING: Soon afterwards, you’ll get a
letter about a hearing with the Clerk
of Court in your county. (be sure to
attend the hearing because you may be able
to get an extension) - HEARING DATE: The lender then presents
documents proving they have the
right to foreclose. - NOTICE OF SALE: If approved, then a public
auction date is set. Notices are posted
at the courthouse and in the
newspaper. - FORECLOSURE AUCTION: Your home
will then be sold at public auction—often on the
courthouse steps. - UPSET BID PERIOD: After the auction,
there’s a 10-day window where others
can then place higher bids. - FINAL SALE:
- if after 10 days with no
new bids, then the last sale becomes final and
the deed transfers to the buyer.
